What are the additional provision options?
At the most, there are three additional provision options: Decision making, Compensation and Dispute resolution. The options you are given depends on how many primary and alternate trustees you have appointed. If you have three or more trustees appointed to act together, you will be shown all three options.
- The "Decision making" section allows you to specify details around how decisions will be finalized. You can decide whether decision making is to be unanimous between all appointees, a majority rule with specified individuals in the majority, or other, where you can specify the details yourself.
- The "Compensation" section allows you to specify details around how trustees will be compensated. The default will always be set at court's discretion. You can also set out the details of a compensation agreement, have it as a fixed amount in the will, detail your own other compensation provision or list that no compensation be awarded.
- The "Dispute resolution" section allows you to specify details around methods of dispute resolution. If a disagreement between trustees arises, you can specify how you would like it to be resolved, either through mediation, consultation, arbitration or resignation.
How do I change the decision making provision?
- Select the pencil button on the right side "Decision making".
- Select your decision making type from the drop-down list.
- Click “Done” in the bottom corner to save.
How do I change the compensation provision?
- Select the pencil button on the right side "Compensation".
- Select your compensation type from the drop-down list.
- If you wish to exclude specific trustees from receiving compensation, click on "Excluded" and select their names from the drop-down list.
- Click “Done” in the bottom corner to save.
How do I indicate a method of dispute resolution?
- Select the pencil button on the right side "Dispute resolution".
- Click the button on the right side of the dispute resolution method you would like to choose.
- Enter in the details in the description field.
- Click “Done” in the bottom corner to save.
