Some lawyers prefer their wills to have the specific trust provisions for gifts in a separate section. In this way, the core residue trust gifts are listed in the residue section which then refers to the specific trust provisions (such as the trust duration, mandatory payments, encroachment and gift-overs) for that gift in a separate section.
You can set up your will precedents to do this for residue gifts. This option is found under "Gift Options" for a will. Select "Use Pullout Trust" and any residuary trust gifts will be created in this format.
Note: this only applies to residuary trust gifts.
Suggestions:
- Pull Out trusts work best when the gift-overs do not include a complicated Specific Distribution gift-over.
- Where there is a spousal trust, Pull Out trusts, should only be used with caution.
